Definitions / Interpretation
In these conditions, Want2auctionit act as agents for the vendor. Any reference to Want2auctionit shall include a reference to its employees and agents from time to time. Words importing one gender include all other genders and words importing the singular include the plural and vice versa. Reference to a person includes an individual, firm, corporation (limited or unlimited) or any other body. The clause headings are not to be taken into account in the construction and interpretation of these Conditions ‘fall of the hammer’ will mean when the last bid has been made or the auction has ended. ‘Listing’ refers to any auctions conducted online. ‘Auction house’ means an auction carried out by an auctioneer which is conducted by the gavel and not online
 
General
Whilst Want2auctionit make every effort to ensure the accuracy of their descriptions of any item:

• (a) Each item is sold by the vendor with all faults, imperfections and errors of descriptions.
• (b) Want2auctionit do not accept responsibility for the authenticity, attribution, genuineness, origin, authorship, date, age, period, condition or quality of any item, unless they have been instructed in writing by the vendor so to certify and in such cases Want2auctionit do so as agents of the vendor and are not themselves responsible for such claims
• (c) All statements, whether printed in a catalogue listed online  or made orally, as to any of the matters set out in (b) above are statements of opinion only and are not to be taken as being or implying any warranties or representations of fact by Want2auctionit, unless they have been instructed in writing by the vendor so to certify and in such cases Want2auctionit do so as agents of the vendor and are not themselves responsible for such claims
• (d) Any claim under any Statute must be received in writing by Want2auctionit within 7 days of the day of the sale

The sale

• (a) Want2auctionit has absolute discretion to divide any item, to combine any two or more items or to withdraw any item or items from the sale, to refuse bids, regulate bidding or cancel the sale without in any case giving any reason or without previous notice. We may bid on behalf of the vendor for all goods which are being offered subject to reserve excluding means which prohibit such bidding i.e. EBay or at want2auctionit's discretion.
• (b) The highest bidder shall be the buyer except in the case of a dispute if during the any auction want2auctionit considers that a dispute has arisen, w2ai has absolute discretion to settle it or to re-offer the item and Want2auctionit may at sole discretion determine the advance of bidding or refuse a bid.
• (c) Each item is put up for sale subject to any reserve price placed by the vendor.
• (d) All conditions, notices, descriptions, statements and other matters in any listing and elsewhere concerning any item are subject to any statements modifying or affecting the same made by want2auctionit or by the chosen auctioneer from the rostrum prior to any bid being accepted for the item
• (e) Want2auctionit  & the vendor will adhere to the terms and conditions stated by the chosen place of sale, all terms of conditions will be available from the company instructed to sell the item

Fees
by agreeing to the terms & conditions the vendor authorizes want2auctionit to arrange sale by auction or private treaty the items left with want2auctionit, to wrap and post their goods for the price achieved. The vendor authorizes want2auctionit to retain the appropriate fees based o the final auction/sales price actually paid by the buyer as our commission
Proof of Identity
Want2auctionit operates a policy where the details of each vendor are recorded. The vendor is then given a members number free of charge. In order to become a member Want2auctionit will need to see2 pieces of identification which includes the persons name, address or both, in the case of a current photo id i.e. Passport or driving licence card with photo, no further id will be needed, once the details are recorded the vendor need not produce id for further transactions. Want2auctionit will not knowingly give out the personal details of any member except in the following conditions

• Requested by a legal body i.e. police or the courts
• In the event of a dispute regarding ownership
• At the companies discretion

Payment
Once we are in receipt of the cleared funds we will dispatch the items to the buyer unless sold by auction house where the responsibility of dispatch will be made by the auction house. Payment will be made by the company to the vendor by cheque when the company is happy that all money is cleared
Non – paying bidder
If the item is subject to a non paying bidder the company will report the bidder to the relevant organisation, the vendor has the options of either the item being re-listed free of charge (subject to the item having one or more under bidders), offered to the next highest bidder or returned to you (if the item is returned to the vendor the relevant costs will be charged before the item is released.
Unsold Items
Any unsold items must be collected within 7 days of notification. Any item that hasn't’t been collected after 30 days will be treated as abandoned and the company will dispose of the item/s by any means chosen and any monies obtained from the sale will be offset against cost of storage.

Rescission
Notwithstanding any other terms of these Conditions, if within 30days after the sale Want2auctionit have received from the buyer of any item notice in writing that in his view the item is a deliberate forgery and within 7 days after such notification the buyer returns the same to Want2auctionit in the same condition as at the time of sale and by producing evidence, the burden of proof to be upon the buyer, satisfies Want2auctionit that considered in the light of the entry in a catalogue or listing the item is a deliberate forgery; then the sale of the item will be rescinded and Want2auctionit will reimburse the buyer for the amount paid for the relevant item within 30 days of the vendor refunding to Want2auctionit the amount paid to the vendor in respect of the item In the event of a dispute then the matter shall be settled by arbitration, the arbitrator to he nominated by the owner of Want2auctionit Both the buyer and the vendor agree to be bound by the decision Payment of costs of arbitration shall be made by the losing party.

Default
Want2auctionit disclaim responsibility for default by either the buyer or the vendor because they act as agents for the vendor only and therefore do not payout to the vendor until payment is received from the buyer. Instructions given by telephone are accepted at the sender's risk and must be confirmed in writing forthwith.

Private Treaty
In the event of a sale by private treaty the buyer agrees to be bound by these Conditions and any Special Conditions advised to the buyer before the sale
 
Instructions
As Want2auctionit are agents, all goods delivered to Want2auctionit premises will be deemed to be delivered for sale by auction either by means of a chosen online auction site or by an auction house who will be a member of RICS or unless otherwise stated in writing and will be listed and sold at Want2auctionit discretion and accepted by Want2auctionit subject to all the Sale Conditions. By delivering the goods to Want2auctionit for inclusion in their auction sales each vendor acknowledges that he has accepted and agreed to be bound by all these Conditions

Storage
Want2auctionit reserve the right to store or arrange for the storage (either on their own premises or elsewhere at their sole discretion) of goods delivered to them for sale and/or sold by them. The vendor or buyer as appropriate shall be liable for all and any charges payable for storage, transport and insurance of such goods.

Right to Sell
Buyers will incur charges for storage in respect of goods left on Want2auctionit premises or in the custody of Want2auctionit or their appointed storage contractor If the buyer has been requested to remove such goods but the goods are not removed within seven days of such request, Want2auctionit reserves the right to sell the goods without further reference to the buyer to defray such charges incurred The maximum liability which there may be on the part of Want2auctionit to the buyer in respect of any loss arising from any such sale shall be restricted to the price paid by the buyer for the goods

Reserves
All goods are put up for sale WITHOUT RESERVE at want2auctionits discretion unless written instructions as to reserves are received by Want2auctionit prior to the commencement of the sale.  Reserves must be given in writing to Want2auctionit either 2 days before the item is sold by auction house, or 5 days before the end of an online auction. If the reserve is placed or altered on an online auction that is active the auction will be ended and re-listed all fees incurred will be deducted from monies paid.
 
Indemnity
The vendor shall duly indemnify Want2auctionit against any claims in connection with any goods sold by Want2auctionit on the vendor's behalf.

Value Added Tax
A vendor who sends for sale by auction or private treaty any item which is an asset of his business must disclose to Want2auctionit whether or not he is a registered person for Value Added Tax purposes in the UK or any other AEU country and if so, declare his registered number and whether or not he intends to operate the special scheme for second hand goods This information must be supplied to Want2auctionit on, or prior to, the items being consigned to Want2auctionit. If VAT is required on an item being sold by online auction, vat will be charged to the buyer who will be aware of VAT as mentioned clearly in the listing, this vat will be given with final payment to the vendor who bears the responsibility of paying that VAT to the appropriate authorities according to any applicable laws and regulations

Vendor Authorisation
The vendor authorises Want2auctionit to deduct commission and expenses at the stated rates from the hammer price and acknowledges Want2auctionit right to retain any premium payable by the buyer to Want2auctionit.
The vendor acknowledges that Want2auctionit can not guarantee the final selling price, any price valuation is only to be used as a guide and has been based the information available.

Rights to Photographs and Illustrations
The vendor gives Want2auctionit full and absolute right to photograph and illustrate any item placed in its hands for sale and to use such photographs and illustrations and any photographs provided by the vendor at any time at its absolute discretion (whether or not in connection with the auction) The buyer gives absolute right to use at any time any photographs and illustrations of items sold at auction or privately at its absolute discretion (whether or not in connection with the auction). In addition to the above the attention of all bidders and buyers is drawn to the following clauses which principally concern buyers and to other notices and information in the catalogues or online listing,

Inspection
Each buyer by making a bid for a item acknowledges that he has satisfied himself fully before bidding inspection or otherwise as to all the sale terms, these Conditions, the physical condition and description of the item including but not restricted to whether the item is damaged or has been repaired or restored.

Powered / Mechanical items Disclaimer
Refer to items that run by means of electrical power or mechanical means. All electrical items are primarily sold in an untested condition and we strongly advise that before plugging any electrical appliance into the mains power you have it appropriately tested by a qualified electrician, we will list items where possible giving a good but in no way guaranteed condition.

Property and Risk
Legal title will not pass to the buyer until the item(s) has been paid for in full, but each item is at the sole risk of the buyer from the fall of the hammer Each buyer shall forthwith give his full names and permanent address and if called upon to do so by want2auctionit shall forthwith pay to Want2auctionit such proportion of the purchase price as Want2auctionit or want2auctionit may require If the buyer fails to do so, the item may at want2auctionit's sole discretion be put up again and re-sold.

Bidding for own items
Most auction companies cover vendor bidding for own item/s in their terms and condition’s, Want2auctionit prohibits any vendor from bidding on any item instructed to be auctioned by the vendor. If the vendor ignores this condition and bids for there own item/s they do so at their own risk, any fines, penalties or action taken against or incurred by want2autionit will be recovered from the vendor, also compensation for lose of business or assets will also be claimed from the vendor, If the vendor is the winning bidder the item will be treated as sold and charges will be made as per the commission rates applicable, items will not be returned to the vendor until all payments are made

Bidders Status
Every bidder shall be deemed to act as principal unless there is in force prior to the sale a written acknowledgement by Want2auctionit that he acts as agent on behalf of a named principal.

Removal of Goods

• (a) No purchase shall be claimed, removed or shipped including postage until it has been paid for in full and the sale has been concluded.
• (b) If the buyer fails to pay in full for any of his purchases by close of business on the seventh working (7days after the day of the sale then the buyer shall be in default and Want2auctionit shall at its absolute discretion be entitled to: Charge to the buyer interest on any purchase price (as defined in clause 20) that remains unpaid at a rate which is ten percentage points per annum above the base rate of National Westminster Bank plc as at the date such interest is charged.
  Exercise a lien over any items purchased by the buyer and over any other property of the buyer in the possession custody or control of Want2auctionit for any purpose at that time (or which subsequently comes into Want2auctionit' possession) until such time as Want2auctionit have received settlement in fun of an amounts due from the buyer.
  Resell without notice to the buyer any item for which payment has not been received in full by Want2auctionit. The maximum liability which there may be on the part of Want2auctionit to the buyer in respect of any loss arising on any such re-sale shall be restricted to the price paid by the buyer for that item.
• (c) If the buyer fails to comply with any of these Conditions, Want2auctionit reserves the right to refuse to accept any bids made by or on behalf of the defaulting buyer at any future sales or to require the client to deposit in respect of any potential purchase such an amount in cash as Want2auctionit in its absolute discretion deems appropriate before any bids are accepted from that client in any subsequent sale
• (d) If the buyer fails to comply with any of these Conditions the amount recoverable by the seller, Want2auctionit from that buyer shall include any loss arising on any resale of the item together with the charges and expenses in respect of both sales and interest on all outstanding sums at a rate which is ten percentage points per annum above the basic rate of National Westminster Bank plc as at the date such interest is charged Any money deposited in part payment shall be held by Want2auctionit on account of any liability of that buyer to Want2auctionit or to the seller .
• (e) Arrangements are made with storage contractors for storage and collection of furniture, some associated items or larger items, these will be at the cost of the vendor unless other arrangements have been made by want2auctionit 

Bidders on online auctions
By placing of a bid on any lot listed by want2auctionit the bidder accepts the fact that we have listed and described the item to the best of our knowledge, we have not and will not list or describe any item with the intention of dishonourable conduct. We endeavour to list and describe the items in as accurate as possible. It is the responsibility of the bidder to satisfy themselves for what they are bidding for. We offer a question answer service by email, telephone and the option of examination of any item during a pre booked appointment
We reserve the right to cancel any bids at our discretion by any bidder that has a low feedback or with what we consider a bad feedback
Returns Policy

• Buyers beware in the case where the buyer cancels payment or activates a charge back by payment method either involving a credit card or Paypal account, Want2auctionit will treat this as fraud and the relevant actions will be instigated to recover the cost of the item, the cost involved with administration, court costs, legal costs and any costs incurred by debt collection companies, All actions will be reported to the relevant body i.e. EBay fraud department, The police Fraud department, Please remember all returns must be action via our Returns Policy, Fraudsters be aware we WILL recover all costs via debt collection agencies
• If a bidder wishes to return an item they must first contact either by phone or in writing before doing so. Items will only be accepted under the returns policy if the item deferrers greatly from the description. Where Items qualify and are accepted for return Want2auctionit will contact the purchaser in order to make the necessary arrangements. Any person who sends items back without returns authorisation do so at there own risk and cost, Want2auctionit will not reimburse any costs that have not been agreed.
• Breakages / lost items. Want2auctionit take great pride in making sure all items are securely packed so the buyer receives the item in the condition it was advertised. If an item is received broken, the buyer must notify us within 24hrs of receipt of the item, We are not responsible for breakages incurred whilst in delivery or lost in transit claims these are the responsibility of the courier company used, we will do all we can if notified within 24hrs to help recover costs if they are to blame. Broken items that are not available for inspection will not be processed.
• Where options of insurance, special delivery and ‘signed for’ are offered we strongly advise the buyer pays for the relevant option, where any of these options are offered but not chosen, we will only assist with the claim against the courier at the companies discretion

Loss or Damage
Want2auctionit disclaim all responsibility for loss or damage to goods or for unauthorised removal of goods unless caused by the direct negligence of w2ai employees when Want2auctionit maximum liability shall be limited to the purchase price paid by the buyer for those goods.

Third Party Liability
Every person on Want2auctionit premises at any time shall be deemed to be there at his own risk. He shall have no claim against Want2auctionit, its employees or agents in respect of any accident which may occur; or injury, damage or loss howsoever caused, save insofar as the injury, damage or loss shall be caused by the direct negligence of Want2auctionit employees.

Consumer Protection Act 1987

• Post 1950 upholstered items must bear the relevant fire retardant label stating that the lining and covering of such item complies with the current fire regulations.
• Electrical goods must have approved wiring with 13 amp insulated plug. Heaters/fires must have approved guards.
